TERMS OF BUSINESS

1.1 GENERAL:

Dilapidations Direct Limited, “dilaps direct” performs professional Consultant Building Surveying services as defined by the Royal Institution of Chartered Surveyors (RICS).

All types of services offered are referred to in this agreement as “Building Surveying Services”.


1.2 FEES:

1. All fees are exclusive of Value Added Tax (VAT) charged at the prevailing rate.

2. All fees, unless otherwise stated are exclusive of disbursements, charged as follows:

a. Stated costs e.g. rail travel plus 12.5% administration
b. Plan printing A1 @ £5.95 ea., A2 @ £4.20 ea., A3 @ £3.45ea.
c. Mileage @ £0.59/mile
d. Colour printing A4 @ £2.50/page, A3 @ £4.20/page

ALL THE ABOVE ARE EXCLUSIVE OF VAT

Note: Travel is calculated from the nearest IOD base to the property address and back i.e.;

3. Where projects become abortive, they shall be charged on the basis of time and costs expended at the point of cessation. Time will be charged in accordance with the published hourly rates (see 1.2.5).

4. If a project extends beyond the original brief, unless otherwise stated, the project will be charged on the basis of cost and time expended. Time will be charged in accordance with the published hourly rates (see 1.2.5).

5. Fee for preparing or checking a schedule:

Where hourly rates have not otherwise been agreed, the published hourly rates apply:

a) Principal Dilapidations Surveyor £129.00/hr
b) Chartered Dilapidations Surveyor £ 64.50/hr
c) Case Manager £ 33.00/hr
d) Assistant Case Manager £ 16.50/hr

ALL THE ABOVE ARE EXCLUSIVE OF VAT

6. Fee for settling a schedule by negotiation:

a. For acting on behalf of the Landlord in settling the amount or monitoring and approving work carried out by the tenant in compliance with the schedule.

10% on the first £5,000.00
6% on the next £5,000.00
5% on the residue of the amount of settlement or the value of the works carried out.

Minimum fee £500.00

b. For acting on behalf of the Tenant in settling the amount

7.5% on the first £2,000.00
5% on the residue of the amount claimed by the landlord of (if that amount has not been quantified) of the estimated cost of complying with the landlord’s schedule.

7. dilaps direct reserves the right to charge interest on fees unpaid within 28 days of an invoice date. A rate of 4% above Barclays Bank plc base lending rate will apply calculated on a day-to-day basis as from the date of the invoice until the date of payment.


1.3 OTHER TERMS OF BUSINESS:

1. dilaps direct operates a complaints procedure in accordance with RICS requirements, a copy of the same can be requested or supplied by applying to:

These terms and conditions are deemed to apply, without exception, unless specifically varied in writing by a Director of dilaps direct.


1.4 PAYMENTS TO THIRD PARTIES

1. dilaps direct do occasionally make payments to introducing agents. This is on the basis of 6.5% of the gross fee minus disbursement. Once instructed we will disclose the nature of any payments made to third parties as commission.
